This Privacy Policy & Notice (the “Policy”) is dated and effective April 6, 2021.

A&E respects your privacy and is committed to protecting it.  This Policy explains the ways in which A&E gathers information while you use this Website, the ways in which we maintain, use and share that information, and your rights concerning your personal information.  It is our goal to collect, use, maintain, protect and disclose personal information in a responsible manner, whether we do so in the context of interacting with visitors to this Website, developing business, providing services and products, or managing our relationships with our tenants, applicants, employees and service providers (collectively, the “Services”).

This Policy DOES NOT apply to:

  1. Information which is publicly available, anonymized or aggregated, and other information which is excluded from the scope of applicable privacy laws; 
  2. Information that you may provide to us or that we may collect through means other than this Website; and
  3. Information that you provide to or is collected by any third party, including via links on this Website. These third parties, their websites and apps may have their own privacy policies, which we encourage you to read before providing information on or through them. 

Please read this Policy carefully to understand our data practices. Our Policy, applicable law, and our terms of use and other agreements with you, together govern our relationship as it relates to your personal information.  Through your use of the Website and the Services, you accept the terms of this Policy and consent to the data practices we describe in this Policy.  If you do not agree with our policies and practices, do not use the Website and the Services.

A&E reserves the right to change this Policy at any time.  Your continued relationship with us after the posting or notice of any amended privacy policy or notices shall constitute your agreement to be bound by such changes.  Any changes to this Policy will take effect immediately after being posted or otherwise provided by us.  We may provide supplemental or updated privacy notices on specific occasions when we are collecting or processing your information.  This Policy is not a contract and does not create any contractual rights or obligations.

Categories and Sources of Information

We collect, use and share personal information from various sources to perform the Services and to accomplish our business and commercial purposes and objectives.  You may provide us with information in order to use or participate in certain features of this Website or the Services.  For example, you may provide your name, email address, phone number or other contact information or content to enable us to furnish you with Services and information, and otherwise to continue our interaction with you.  Should you choose not to provide some of the information we request, we may be unable to provide you with one or more features of this Website or the Services.  

As further discussed below, similar to other Internet services, the Website uses “cookies,” small pieces of computer code that enable our Internet servers to recognize a user each time they initiate a session on our Website.  Along with cookies, pages of the Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit the Company, for example, to monitor the uses of those pages or messages.

When you access the Website, your browser will provide us with certain information automatically.  This information includes, but is not limited to, information about the Internet Protocol (“IP”) address or other identifier assigned to your device; browser type, version and settings; operating system type, version and settings; Internet Service Provider (“ISP”); platform type; country and other location information; your device’s preferred language; domain name; your AdID (the unique identifier assigned to you for advertising purposes) and unique user identification number randomly assigned by us; other characteristics relating to your device, its software and mode of communication with us; and information regarding your visit to the Website, such as the date and time of your visit, the pages you visit and the links you click, the time spent on the Website or usage of certain Website features, and/or external websites from which you arrived at the Website or to which you linked.  If you access the Website using your mobile device, we collect other information including, but not limited to, the unique device ID number of the device; the unique identifier assigned to the device for advertising purposes, such as your Identifier for Advertising (“IDFA”) on iOS devices or your Google Advertising ID (“AAID”) on Android devices; device model and address, operating system and version, and/or mobile communications carrier.  We also may collect location data that is provided by your mobile device (if you enable that feature and share that information with us), your ISP or a third party data provider. Information we collect may be associated with accounts and other devices. 

Anonymized or Aggregated Information. We record certain anonymized or aggregated information about your use or evaluation of the Website.  Anonymized or aggregated information is used for a variety of functions, including the measurement of interest in and use of various portions or features of the Website or Services.  Anonymized or aggregated information is not personal information, and we may use such information in a number of ways, including internal analysis and research.  We may share this information with third-parties in an anonymized or aggregated form that is designed to prevent anyone from identifying you.

How we use and disclose information

We use or disclose the personal information we collect to accomplish our business and commercial purposes and objectives and to respond to your inquiries, fulfill your requests, send you communications, and provide other Services.  The information we collect also may be used to personalize your experience.  Our uses of personal information include the following: 

  1. To meet the reason you provided the information and to administer and perform the Services;
  2. To engage in marketing and business development, including without limitation to provide notices and information to our tenants, including prospective tenants;
  3. To provide, maintain, personalize and develop the Website, databases, network, infrastructure, devices, assets and Services;
  4. To debug, including to identify and repair technical errors that impair intended functionalities;
  5. To perform security functions, including to detect security breaches, protect against fraud and malicious activities, and take action against wrongdoers;
  6. To serve and protect the rights, property or safety of our clients, employees, us or others, as necessary or appropriate; 
  7. To perform auditing and due diligence functions, including without limitation for purposes of onboarding prospective clients, legal and regulatory compliance;
  8. To evaluate or conduct a merger, divestiture, restructuring, reorganization, sale, transfer or other transaction concerning some or all of our assets;  
  9. To respond to governmental authorities, including law enforcement requests, and as required by applicable law, court order, or regulations.

We will not disclose personal information to unrelated third parties, except as described in this Policy or as required by law. We may disclose personal information as follows:

With vendors, contractors, consultants, and other service providers, including to perform business and technology related functions and to support the provision of the Website and the Services, but only pursuant to binding obligations requiring such third parties to maintain the privacy and security of such information;
  2. When you give us your consent to do so, including if we notify you (e.g., through this Policy) that the information you provide will be shared in a particular manner and you provide such information;

We do not rent or sell personal information to unaffiliated third parties for their own business or commercial purposes.

We may store some information on your computer when you access the Website. This information is commonly known as a “cookie.”  We may use cookies or other similar technologies in order to better understand how the Website is being accessed and used.  Cookies also help us to determine if the Website is being delivered efficiently.  In addition, Cookies allow us to enhance your online experience by potentially customizing your use of the Website and potentially eliminating the need for you to reenter data every time you visit the Website.  The use of cookies is an industry standard and is used by most major sites to provide the visitor with tailored information. 

Pages of the Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity).

The Website utilizes Google Analytics, an industry standard employed to analyze website traffic and provide aggregate reports of how the pubic interacts with the Website, and we share this data with third-party vendors, contractors, consultants, and other service providers that assist us in operating the Website, providing the Services, and performing data analytics, marketing and advertising on our behalf. There are a few ways that your device may transmit a “do not track” signal to certain websites. There is currently no standard established for these features, and the Website currently does not respond to “do not track” signals.

Children under the age of 18

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  However, no Internet, electronic operating system or data security system is ever completely secure or error free.  We therefore cannot guarantee the security of any information.  We are not responsible for circumvention of any privacy settings or security measures.  By using the Website, you assume the risk of such occurrences.  We request that you do not send, and we will not be liable for your sending, sensitive or confidential information electronically.  Any transmission of personal information is at your own risk.

California Consumer Privacy Act  (“CCPA”)

Consumers who are residents of the state of California have the right to make the following requests (no more than twice in any 12 month period) in connection with your “Personal Information” as defined by the CCPA:

  • Right to Know – You have the right to request to know what Personal Information we collect, use, disclose and (if applicable) sell about you, for what business purpose, from what sources, and with which third parties;
  • Right to Delete – Subject to certain exceptions, you have the right to request that we delete any Personal Information about you that we may hold. We may have grounds to deny your deletion request as provided under the CCPA.
  • Right to Opt-Out of Sale of Personal Information – You have the right to opt out of the sale of your Personal Information. A&E does not sell your Personal Information.
  • Right to Non-Discrimination – You have the right not to be discriminated against because you exercised any of your rights to know, delete or opt-out of the sale of your Personal Information.

In accordance with the CCPA, only you or your legally authorized agent may make a request related to your personal information.  Your request must (1) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or are an authorized representative, and (2) describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it. We cannot respond to your request if we cannot verify your identify or authority to make the request and confirm the requested Personal Information relates to you. Making a request does not require you to create an account with us.  We will do our best to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time, we will inform you of the reason and extension period in writing.  The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
